General terms and conditions of sale of Marinepartsystem

Applicability

  • All Marinepartsystem offers, orders and agreements are subject to these Terms and Conditions. These Terms and Conditions may be copied from the website or may be sent free of charge by us at your request.
  • All Accepting an offer or making an order on or through Marinepartsystem website / webstore means that you accept the applicability of these Terms and Conditions without any reservation.
  • The terms of these Terms and Conditions may be waived only in writing, in which event the remaining provisions of these Terms and Conditions will remain in full force.

Offers / Agreements

  • All offers from Marinepartsystem are free of obligation and Marinepartsystem expressly reserves the right to change prices. If the prices for the products offered increase during the period between the order and its execution, you are entitled to cancel the order or to terminate the agreement within 5 days after notification of the price increase by Marinepartsystem.
  • An agreement will only be made after acceptance of your order by Marinepartsystem. In addition, Marinepartsystem is entitled to refuse orders or to impose special terms on delivery, unless explicitly stated otherwise. If an order is not accepted, Marinepartsystem will inform you within five (5) business days of receipt of the order by e-mail.

Prices and payments

  • The prices quoted for the products offered are in euro, including IVA (margin goods) and for one item only, unless written with the product differently.

  • Ordered goods collected at Marinepartsystem warehouse at the specified time can be paid in cash or by debit / credit card.
  • Ordered goods that have not yet been paid in advance are not shipped and Marinepartsystem reserves the right to dissolve this agreement after written (e-mail) notice.

Delivery

  • Delivery takes place at an expedited rate, but at least within three (3) business days after payment, unless previously indicated by Marinepartsystem. In case of non-delivery by force majeure, you will receive a notice within three (3) days after placing the order and you have the right to dissolve the agreement free of charge by sending a written email to Marinepartsystem.
Exceeding the delivery period does not entitle you to compensation or other compensation.
  • Delivery takes placDelivery takes place when the product is received by (or on behalf of) you.e at an expedited rate, but at least within three (3) business days after payment, unless previously indicated by Marinepartsystem. In case of non-delivery by force majeure, you will receive a notice within three (3) days after placing the order and you have the right to dissolve the agreement free of charge by sending a written email to Marinepartsystem.
  • If the buyer has indicated that he wants to pick up the product at Marinepartsystem warehouse, Marinepartsystem will reserve this or this product (s) seven (7) working days. After that, the purchase agreement will be dissolved without any compensation.
  • With a pickup order, the customer can cancel his purchase without further notice

Retention of title

The ownership of delivered products will not be over until you have fulfilled all of the obligations you owe to Marinepartsystem under any agreement. The risk with respect to the products will be transferred to you at the time of delivery.

Warranty

All items offered by Marinepartsystem come from private, used, margin and / or bankruptcy parties, which prevents the applicable factory warranties. Marinepartsystem can and will not provide any guarantees and can never be held liable for this.

Advertising and Liability

  • You are under obligation to inspect the delivered products immediately after receipt. Any defects found on items should be reported to Marinepartsystem within three (3) business days after discovery by e-mail or motivated with any (digital) photographs.
  • If you do not wish to withdraw a new product for any reason, you have the right to return the product within 14 calendar days after delivery to Marinepartsystem and dissolve the agreement. Returns will only be accepted in this case if the sealed packaging of the product is undamaged and the seal and / or packaging is not broken. The payment already received by Marinepartsystem will be refunded within seven (7) days after the dissolution. The cost of returning will be borne by the buyer and can only be done at Marinepartsystem.
  • Items sent outside the EU, and / or electronic items, and / or items that were not in stock and were specially ordered, and / or items that were specially made to measure, cannot be returned.
  • Used goods, goods with an additional price discount and goods with a defect known at the time of purchase cannot be returned.
  • All shipments are made at the buyer’s risk.
  • All B2B orders have no right of return. Deposited in the dutch law.

Force majeure

  • In the event of force majeure, Marinepartsystem has the right to suspend the execution of your order, or to terminate the agreement without judicial intervention, by notifying you of this by mail and without it Marinepartsystem is liable for any compensation or compensation.
  • Force majeure is understood to mean any shortcoming that can not be attributed to Marinepartsystem, as this is not due to its fault and does not come into force under law, legal act or traffic.

Miscellaneous

  • If you provide an order to Marinepartsystem in the order process, Marinepartsystem is entitled to send all orders to that address unless you provide a different address to which your orders should be sent when ordering.
  • If any of the provisions of these Terms and Conditions with Marinepartsystem are in conflict with any applicable legal provision, then the relevant provision will expire and will be replaced by a new, statutory, comparable provision to be determined by Marinepartsystem.
  • Pictures in the web shop may and can vary from the actual products which Marinepartsystem has in stock.

Applicable law and competent court

  • All offers, orders and agreements to which these General Terms and Conditions apply and to these Terms and Conditions apply exclusively to Dutch law.
  • All disputes between parties will be submitted exclusively to the Dutch court
